Welcome to Bananote! These Terms of Service ("Terms") govern your use of our app and services provided by Bananote, LLC ("we", "us", or "our"). By accessing or using the Bananote app or website, you agree to these Terms. If you do not agree, do not use our Services.

1. Eligibility

To use Bananote, you must be at least 13 years old (or 16 in certain jurisdictions). By using our Services, you confirm that you meet this requirement and are legally allowed to enter into these Terms.

2. Account Registration

You must provide a valid email address to register for an account. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.

3. Acceptable Use

You agree not to misuse the Services. This includes, but is not limited to:

  • Attempting to reverse-engineer or exploit the app
  • Uploading malicious or illegal content
  • Interfering with the operation or integrity of the Services
  • Using the Services for unlawful purposes

We reserve the right to suspend or terminate accounts that violate these Terms.

4. Fair Use Policy

Use of the Services must remain reasonable and consistent with individual personal use. Excessive usage, such as activity that significantly exceeds the typical usage patterns of the average user, may be considered a violation of this policy. If we detect usage that places an undue burden on our systems or is inconsistent with fair use, we may contact you to discuss your needs, limit your access, or require you to upgrade to a custom plan. We reserve the right to determine what constitutes excessive or unreasonable use based on overall customer usage patterns.

5. Subscription and Payments

Certain features of Bananote may require a paid subscription. If you purchase a subscription via the Apple App Store, your payment will be processed by Apple and subject to their payment terms.

Subscriptions may auto-renew unless canceled at least 24 hours before the end of the billing period. You can manage or cancel your subscription in your Apple ID settings.

6. Content Ownership

You retain ownership of the audio recordings and notes you create. By using our Services, you grant us a limited, non-exclusive license to process and store this content solely to provide you with the features of the app (e.g., transcription, summaries, interaction tools).

We do not claim ownership of your content and do not use it for training AI models, advertising, or resale.

7. Intellectual Property

All intellectual property related to the Bananote app, including but not limited to the UI, branding, features, and backend systems, is owned by Bananote, LLC. You may not copy, modify, or distribute our content without permission.

8. Termination

You may delete your account at any time through the in-app settings. We may suspend or terminate your access to the Services if you violate these Terms or if required by law.

9. Disclaimers

Bananote is provided on an "as-is" and "as-available" basis. We make no warranties regarding accuracy, reliability, or availability of the Services. You use the Services at your own risk.

10. Limitation of Liability

To the fullest extent permitted by law, Bananote, LLC shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Services.

11. Changes to Terms

We may update these Terms from time to time. If we make material changes, we'll notify you via the app or website. Continued use of the Services after changes constitutes your acceptance of the updated Terms.

12. Governing Law

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict of law principles.
